พระราชกำหนด • ‎(prá-râat-chá-gam-nòt)

1. (law) emergency decree: decree issued by the monarch upon advice of the executive branch in case of emergency, having the same force as an act of parliament. Abbreviation: พ.ร.ก. ‎(pɔɔ-rɔɔ-gɔɔ).
   • 1932, รัฐธรรมนูญแห่งราชอาณาจักรสยาม พุทธศักราช ๒๔๗๕:

     มาตรา ๕๒ ในเหตุฉุกเฉินซึ่งจะเรียกประชุมสภาผู้แทนราษฎรให้ทันท่วงทีมิได้ พระมหากษัตริย์จะทรงตราพระราชกำหนดให้ใช้บังคับดั่งเช่นพระราชบัญญัติก็ได้ ในคราวประชุมสภาผู้แทนราษฎรต่อไป ท่านให้นำพระราชกำหนดนั้นเสนอต่อสภาเพื่ออนุมัติ ถ้าสภาอนุมัติแล้ว พระราชกำหนดนั้นก็เป็นพระราชบัญญัติต่อไป ถ้าสภาไม่อนุมัติไซร้ พระราชกำหนดนั้นก็เป็นอันตกไป แต่ทั้งนี้ ไม่กระทบถึงกิจการที่ได้เป็นไปในระหว่างที่ใช้พระราชกำหนดนั้น‎

     Section 52 In case of emergency where the House of Representatives cannot be convened promptly, the king may enact an emergency decree to be applied as an act. At the next meeting of the House of Representatives, the said emergency decree is required to be presented to the House for approval. Upon approval by the House, the emergency decree shall continue to be an act. Disapproved by the House, such emergency decree shall lapse; prescribed, however, that this shall not affect the activities having been carried out during the application of the mentioned emergency decree.

     มาตรา ๒๑ เมื่อมีกรณีฉุกเฉินที่มีความจำเป็นรีบด่วนเพื่อประโยชน์ในอันที่จะรักษาความมั่นคงแห่งราชอาณาจักร ความปลอดภัยสาธารณะ ความมั่นคงทางเศรษฐกิจของประเทศ หรือป้องปัดภัยพิบัติสาธารณะ หรือเมื่อมีความจำเป็นต้องมีกฎหมายเกี่ยวด้วยภาษีอากรหรือเงินตราที่ต้องพิจารณาโดยด่วนและลับ พระมหากษัตริย์ทรงไว้ซึ่งพระราชอำนาจในการตราพระราชกำหนดให้ใช้บังคับดังเช่นพระราชบัญญัติ เมื่อได้ประกาศใช้พระราชกำหนดแล้ว ให้คณะรัฐมนตรีเสนอพระราชกำหนดนั้นต่อสภานิติบัญญัติแห่งชาติโดยไม่ชักช้า ถ้าสภานิติบัญญัติแห่งชาติอนุมัติ ให้พระราชกำหนดนั้นมีผลใช้บังคับเป็นพระราชบัญญัติต่อไป ถ้าสภานิติบัญญัติแห่งชาติไม่อนุมัติ ให้พระราชกำหนดนั้นตกไป แต่ทั้งนี้ ไม่กระทบกระเทือนกิจการที่ได้เป็นไปในระหว่างที่พระราชกำหนดนั้นใช้บังคับ เว้นแต่พระราชกำหนดนั้นมีผลเป็นการแก้ไขเพิ่มเติมหรือยกเลิกบทบัญญัติแห่งกฎหมายใด ให้บทบัญญัติแห่งกฎหมายที่มีอยู่ก่อนการแก้ไขเพิ่มเติมหรือยกเลิกนั้นมีผลใช้บังคับต่อไปตั้งแต่วันที่พระราชกำหนดดังกล่าวตกไป‎

     Section 21 When there arises an emergency in which there is an urgent need to maintain security of the kingdom, public safety, economical security of the nation, or to avert a public disaster, or when there occurs a necessity to have a law governing taxation or currency which requires urgent and private consideration, the king shall be invested with the royal prerogative to enact an emergency decree to be applied as an act. Once having promulgated the emergency decree, the Council of Ministers shall present such emergency decree to the National Legislative Assembly without delay. If approved by the National Legislative Assembly, the emergency decree shall continue to take effect as an act. If disapproved by the National Legislative Assembly, the emergency decree shall lapse; prescribed, however, that this shall not affect the activities having been carried out during the application of such emergency decree. But if the emergency decree does result in the amendment or repeal of any legal provision, the legal provision existing prior to the amendment or repeal shall resume its force as from the date the said emergency decree lapses.

     And when the builders laid the foundation of the temple of the LORD, they set the priests in their apparel with trumpets, and the Levites the sons of Asaph with cymbals, to praise the LORD, after the ordinance of David king of Israel.

Usage notes

• As for the first sense, the term only refers to decrees enacted by a monarch. If enacted by any other authority, such as the president of a republic, it is called รัฐกำหนด.
